These Service Terms & Purchase Policy govern the purchase of coaching, hypnosis, flute coaching, workshops, memberships, digital resources, and other services offered by SP Creative LLC.

These Service Terms & Purchase Policy ("Terms") govern the purchase of products and services offered by SP Creative LLC ("SP Creative LLC," "we," "our," or "us").

By purchasing any coaching, hypnosis session, flute coaching, consultation, workshop, class, membership, digital resource, recording, live event, or other product or service (collectively, the "Services"), you acknowledge that you have read and agree to these Terms.

These Terms apply to all purchases unless expressly superseded by a separate written agreement signed by both parties.

Scope

These Terms apply to all Services purchased from SP Creative LLC unless otherwise stated in writing.

Certain Services—such as ongoing coaching relationships or customized services—may also require a separate Coaching Agreement or Service Agreement. If there is any conflict between these Terms and a separately signed written agreement, the signed agreement controls.

Eligibility

Unless otherwise noted, Services are intended for adults eighteen (18) years of age or older.

Services designed for children or teenagers must be purchased by a parent or legal guardian.

Payment

Payment is due according to the payment option selected at the time of purchase.

If you choose a payment plan, you authorize SP Creative LLC to process scheduled payments using your selected payment method unless otherwise agreed in writing.

When you purchase a Service, you are reserving time, resources, and availability specifically for you. Accordingly, your financial commitment is to the full purchase price of the Service. Choosing to discontinue participation, withdraw early, miss scheduled sessions, or otherwise stop using the Service does not release you from your payment obligation. SP Creative LLC may, at its sole discretion, choose to release you from all or part of your remaining payment obligation, but any such decision must be made expressly in writing.

Failure to complete scheduled payments may result in suspension or termination of access to Services, recordings, materials, memberships, or other purchased resources until payment obligations have been satisfied.

You are responsible for any reasonable collection costs, attorney's fees, or other expenses incurred in collecting overdue amounts where permitted by applicable law.

Scheduling and Expiration

Some Services include scheduled sessions, memberships, or packages with defined timeframes.

Any applicable scheduling requirements, expiration dates, renewal terms, membership commitments, or other service-specific policies will be communicated on the applicable sales page, booking page, checkout page, invoice, confirmation email, or individual agreement.

Unless otherwise stated in writing, unused sessions, memberships, or package benefits expire according to those stated terms and are not refundable or transferable.

Cancellations and Refunds

Because many Services involve reserving time, preparing personalized materials, or providing immediate access to digital content, all sales are generally final.

Unless otherwise required by applicable law or expressly stated in writing before purchase:

Consultations are non-refundable.
Completed sessions are non-refundable.
Digital products and downloadable resources are non-refundable.
Workshops, classes, and programs are non-refundable once access has been provided.
Membership fees already paid are non-refundable.

If a particular Service has a different cancellation or refund policy, that policy will be clearly communicated before purchase and will govern that specific Service.

Client Responsibility

Our Services are collaborative and educational in nature.

While meaningful change often comes from active participation and implementation, you remain responsible for your own decisions, actions, participation, and well-being throughout your involvement with any Service.

Educational Nature of Services

The Services provided by SP Creative LLC are educational and personal-development services.

They are not psychotherapy, counseling, medical treatment, healthcare, legal advice, financial advice, or any other licensed professional service.

Nothing provided through our Services is intended to diagnose, treat, cure, or prevent any medical or psychological condition.

If you are experiencing a medical or mental health emergency, please seek appropriate emergency or professional care.

Results Disclaimer

Every individual, situation, and outcome is unique.

Although we strive to provide thoughtful, evidence-informed Services, we make no guarantees regarding any particular outcome or result.

Testimonials reflect individual experiences and should not be interpreted as guarantees of future results.

Intellectual Property

All materials provided through our Services—including written materials, worksheets, recordings, videos, audio, graphics, presentations, exercises, hypnosis recordings, music, downloadable resources, and other original content—remain the intellectual property of SP Creative LLC unless otherwise stated.

Your purchase grants you a personal, non-exclusive, non-transferable license to use these materials for your own individual use. This license is granted solely to the purchaser.

You may not reproduce, distribute, share, teach, publish, record, modify, create derivative works from, license, or resell these materials without prior written permission from SP Creative LLC.

Testimonials, Feedback, and Educational Use.

You may not upload, reproduce, or use SP Creative LLC materials to train, fine-tune, prompt, or develop artificial intelligence systems or machine learning models without prior written permission.

We value the trust our clients place in us and are committed to using that trust respectfully.

By voluntarily providing feedback, testimonials, reflections, or other communications regarding your experience with our Services, you grant SP Creative LLC a non-exclusive, royalty-free, perpetual license to use those materials for educational and marketing purposes unless you notify us in writing at the time you provide the material or within a reasonable time thereafter.

SP Creative LLC may also share anonymized or de-identified stories, experiences, or examples drawn from our work together for educational, teaching, or marketing purposes. Identifying details may be modified, omitted, or combined to help protect client privacy while preserving the underlying learning or experience.

We will not use your name, photograph, video, voice, or other identifying information in public-facing marketing without your permission.

Community Standards

Some Services include live group experiences or private online communities.

Participants are expected to contribute respectfully and professionally. SP Creative LLC reserves the right to remove posts, comments, or shared materials that violate these standards.

SP Creative LLC reserves the right to remove any participant whose conduct is abusive, discriminatory, threatening, disruptive, harassing, or otherwise interferes with the safety or learning experience of others.

Removal for violations of these standards does not create a right to a refund.

Recordings

Certain workshops, classes, group programs, or educational events may be recorded.

By participating, you acknowledge that your voice, image, questions, or comments may appear in those recordings.

If recordings will be shared with participants as part of the purchased Service, you will be informed in advance.

Participants may not make audio recordings, video recordings, screenshots, or redistribute recordings without prior written permission.

Access to Digital Services

We reserve the right to update, improve, replace, or discontinue digital materials, memberships, portals, or online platforms from time to time.

If lifetime access is offered, it means for the lifetime of the Service while it continues to be maintained by SP Creative LLC, unless otherwise stated.

Limitation of Liability

To the fullest extent permitted by applicable law, SP Creative LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your purchase of or participation in any Service.

Any liability arising from a purchased Service shall be limited to the amount you paid for that specific Service.

Indemnification

You agree to indemnify and hold harmless SP Creative LLC, its owner, employees, contractors, and representatives from any claims, liabilities, damages, losses, or expenses arising from your misuse of the Services or your violation of these Terms.

Arbitration

If a dispute arises relating to these Terms or any purchased Service, the parties agree to first attempt to resolve the matter through good-faith discussion.

If a resolution cannot be reached, the dispute shall be resolved through final and binding arbitration pursuant to the Federal Arbitration Act before a single neutral arbitrator administered by the American Arbitration Association or another mutually agreed-upon arbitration service.

Judgment upon the arbitrator's decision may be entered in any court of competent jurisdiction. Arbitration shall take place in Buncombe County, North Carolina, unless the parties mutually agree otherwise.

Governing Law

These Terms shall be governed by the laws of the State of North Carolina without regard to its conflict of law principles.

Force Majeure

SP Creative LLC shall not be responsible for delays or inability to provide Services resulting from circumstances beyond our reasonable control, including natural disasters, illness, government action, public health emergencies, internet outages, or other unforeseen events.

If such circumstances occur, we will make reasonable efforts to reschedule, modify, or otherwise fulfill the purchased Service. SP Creative LLC may also provide a reasonable substitute service or comparable accommodation at its discretion.

Changes to These Terms

SP Creative LLC may update these Terms from time to time.

The version in effect at the time of your purchase will govern that purchase unless otherwise required by applicable law.
